1. As a part of the management team, how would you handle distribution and marketing of the O-Fold? Within the text I really liked the 2nd and 3rd option of distribution, which was going an online route or advertising I travel magazines. Although the adverting in magazines option is appealing when it comes down to it I don’t think it would reach as many people as online distribution. I would chose to create a website and distribute the O-Fold product through there. Creating a website would be extremely cost effective. I believe there are even some sites you can use for free, such as weebly.com. However, this option is risky because marketing would have to be very effective in order to generate the business he is looking for. Since the cost of a website is low, he should consider advertising in travel magazines. He probably would not need large ad space, which would help with the cost. If he could get a small section in the Sky Mall magazine on aircrafts with the link to his website, that could be a rewarding starting point. Another option is advertising on other large online retail sites, such as Amazon.com who now gives consumers an option to purchase provides from other retailers by providing a link to that product on their site. 2. At what points should Alex consider bringing on additional management? What positions should he fill and in what order? Defend your answer. I am a supporter of Alex’ crawl-walk-run strategy. I think initially he should partner with his brother and begin to make the product together and sell online through a website he creates. This way he can get an idea of how he can proceed with next steps and be able to create a business plan to present to Anger investors. Once he can seal the investment funds he should bring on a sales and marketing manager. This is one of the most important positions in a company. Alex needs to have someone with experience in sales and marketing, especially not having experience himself. He’s already contemplating different options in this area; someone who has worked in this department can give him real examples of the outcomes and weigh in on the best decision for O-Fold. Next, after he gets an investment, he should go with the outsourcing route. He already had a connection to hire a barn full of employees. He will need to hire a manager to oversee the production of these employees, and also a Human Resources Manager since he will have employees. He cannot manage everything himself so a good candidate for the productions manager would be his brother since he should have a good understanding by then of how to produce the items. 3. What are some pricing strategies you would consider utilizing in order to get the O-Fold to market? Do you agree with Alex’s pricing point? I would consider giving a special price to first time customers, or a discount when purchasing more then one O-Fold at the early stages of marketing. Alex will want to be competitive and the first thing that customers probably look for is good deals. If he creates a website and is directing people there through advertising he should try to close the sale with a discount. An option would be first time users get free shipping, or $5 off shipping. Customers buying more then one could receive $5 off their second purchase. I like the 123 percent market with the outsourcing options at $12.50 However, that would only be beneficial at wholesale, so he should price his products per item at $25, and offer the discount for the first 100 customers. He does not need to advertise the part about it only being for the first 100 customers but he should price out shipping costs for 100 people or costs of giving discounts and set a budget for it.

Holder in Due Course

A Holder in Due Course can be defined as a holder who takes a negotiable instrument in good faith, without noticing that such instrument has been dishonored or that there is a hiden fraudulent issue behind it. In this particular case, I don’t think that Any Kind Checks Cashed, Inc. should be considered as a Holder in Due Course. It is clear that ‘Any Kind’ company did not know what the issue behind that check was but, they should have speculated that there was something strange going on.Apparently, there was a business that had been operating for a while and that they understood and know what kind of people will normally visit their store to cash their checks. I consider that the issue arises when Michael of Any Kind Cashed Checks, decides to pay a portion of the check made by Talcott and deposit the rest without trying to reach the drawer in order to confirm such transaction. I think that doing so, Any Kind Cashed Checks failed to comply with the reasonable comme rcial standards of fair dealing such as good faith.If Talcott was unreachable, Michael should have Guarino come back at a later time or at least called the bank and see what the status of the check was. One thing is clear; Guarino did not attempt to go to the bank because he knew something could go wrong if he did. If Any Kind Cashed Checks would have only noticed that a broker shouldn’t have anything to hide and that a person like him would normally go to the bank instead of a checks cashing store the story would have surely been different.Personally, I agree and disagree with the court’s decision over this case. I consider that Talcott shouldn’t be liable for the $5,700. He actually was victim of a fraud and he has valid real defenses against Rivera and Guarino. Any Kind is not in fault in this specific scenario because they waited for the owner’s confirmation in order to cash the check. I would think that Talcott would be able to get his money back and of course sued these two men who took advantage of his age to cheat.On the other hand I believe that Any Kinds should be held liable for the $10,000. Furthermore, Michael specifically, which as a supervisor should have not only known the procedure but should have also followed it. I am guessing she was lead by the fact that she would have received a nice commission out of a $10,000 check and didn’t think twice when she cashed and deposit the check without the owners approval. The case doesn’t state much information on this but if I am not wrong she also lost due to the fact that the check had a stop payment request by the owner.In conclusion, I would like to state that I don’t believe Any Kind Cashed Checks is or should be considered as an HDC due to the fact that they relied on their own judgment and experience at the moment of cashing and depositing the $10,000 check. There is a clear failire to the good faith principle in such a scenario. Moreover, showing a federal express envelope to prove that Talcott truly sent the check shouldn’t be sufficient evidence to prove everything is correct.

They used examples like Adidas, HM and Microsoft as good companies to look at as examples. A strong foundation to a business will be a huge help in making the business successful and profitable as quickly as possible. This being said the business that I would love to open is a garden center or nursery. Marshalls is going to be a leader in indoor tropical houseplants and foliage. We will not only sell the plants but offer landscaping  services and free classes to customers on how to maintain the plants that they do have. I have worked in this field my entire life and have seen many businesses of this type come and go for many reasons. I feel that after working in the field for 12 years I have a good grasp on the reasons why people were successful and unsuccessful. This alone will help me dramatically in the formation of the business because I will not make many of the same mistakes that other companies I have worked for made in the past. The next level will be three yard managers. Yard managers are responsible for ensuring that everything is completed in the yard and that all of the plants are looking healthy. The will have the ability to delegate to any of the 10 employees working under them. The basic employee will be hourly and do all of the daily task such as helping customers to their cars and watering all of the plants. Everyone will know what the hierarchy is in the company and know who they can go to for help. The plants are going to be from around the world and from many different growers and all have very specific needs. Marshalls will be able to not only sell the plants to the customer but also help them place them in the home where they will flourish. This service will be at an extra charge but to ensure that the plants will do well and produces blooms it will be very helpful. If we can try and get every customer to use our in home care service than it will take the company to a new level of profitability. Price is going to be the most difficult thing for Marshalls. It’s very expensive to ship plants in a heated truck during the winter, but it’s crucial to the success of the business to do so. This will drive the price up a lot. Also by keeping it in a cold climate we eliminate a lot of competition. The majority of these plants can be bought in warm climates but are nearly impossible to find in Michigan. I have also looked at the growth potential and have found that because of cheap real estate people have been moving to this area quickly. The cheap real-estate also helps because I can afford a better location and building for Marshalls. Promotion is going to be vital to the success of the business. This is going to start with advertising and led directly into the customer service that we give our clients. We are going to do many different types of advertising. This will start with using yellow pages and direct mail. With the yellow pages site we can also hit the internet  marketing with a pay per click campaign. This means that we o nly pay when people click on the ad. Often its five cents per click and you pay depending on how many people click. We have also been working with a lot of local gardening magazines to advertise to our local customers and let them know we are now in town. We will do a free orchid campaign to the first 500 customers at the store to draw people in. This may cost us a lot at the start but in the long run will get the word out that were open and have a quality location. As a company we will also be performing a SWOT analysis on the business before we start. The advantage to this is that it really shows you where your business is and what needs to be improved on. SWOT consists of four things your company’s strengths, weaknesses, opportunities and threats. Marshalls Nursery has many strength’s. The first thing that is very evident is that I have worked in this type of business for over 12 years and have seen where other companies have succeeded and failed. With this knowledge I should be able to be proactive and not reactive as much. Stopping a problem from the start is huge advantage. I also have made a lot of connections in this type of business that will help me with prices and shipping. Majority of the potential weaknesses that I see are things that will be able to be stopped with proper planning. The first thing that I see as a problem is the lack of working capital that has to start the business. I need to have more capital on hand in order for the business to run to its full potential and for me not to put my own lively hood at risk. Also the lack of reliable workers is another thing that will be difficult. When dealing with exotic plants it will be important that my staff is well trained and knows a lot about the plants and how to care for them. Since we will have mostly tropical plants it will be hard to find adequate candidates. Opportunities that Marshalls may have are being the first business in the area to sell this product and offer in home services to go along with it. Also Michigan State University is the United States leading agriculture and hortic ulture school. This will help because I can use interns that are studying the field and even get potential job applicants straight out of college. We can also open many different locations down the line if the initial location does well. The biggest threat to the company is going to be the climate in Michigan. If we have an extremely cold winter which has happened several times in the past it’s  going to make quality shipping very difficult. Most tropical plants can’t tolerate temperatures under 40 degrees for longer than a couple minutes before getting damaged. Also, if we start doing well it will be very tempting for our competition to start replicating what we are doing. This will be a potential long term threat for the company. This marketing plan is just the beginning of success for the company. It may be the most important part of the process however, this is going to make or break your company. If we realize not only our successes but also our failures and act on them before they happen than we will be a much better company. Daily operations for a business are going to be the bread and butter of your business. A company is often made profitable on how they are run. This can be anything from giving serving customers to obtaining product from vendors half way across the country. The more streamline, efficient and friendly you are will increase margin and in the long run profitability. Often the company that is around in five years is the ones that have figured out how to have the best daily operations. Marshall’s nursery is retail and a services business. Making Marshalls not only a retail but service business will make the operations more difficult but also a lot more profitable. Being able to not only offer to sell items to people but also maintain and pot the exotic plants. I will list how general operations will go for the retail side of the business and the service side. The operations for the store aspect of the business are pretty simple and just like most other retailers. The most important aspect of the business is going to be a good shipping method. We will use heated/cooling trucks that will be able to keep the plants at an exact 75 degrees for the entire tripe to ensure maximum freshness and quality for the customers. Shipping will be very important can have a huge impact on inventory levels and the amount of plants we can carry. We have decided to go a different route than most other nurseries in the area and do all of our own shipping in house. The reason for this is the ability to not only ensure quality but be able to pick select plants and stay in face to face contact with our growers. Our Growers are going to consist of four different companies. We have selected these companies because they have a great reputation and I also have contacts with them that will get us a lot better deal than going elsewhere. The first company that we are going to use is Costa Nursery. Costa is a large scale nursery selling anything from rare plants to the common marigold. I have dealt with them for over 6 years and love their product. They will provide us with mainly orchids and bromeliads. The second is going to be Florida tree farm, they have a large selection of indoor palms that you cannot buy anywhere else in the country. Dewar’s nursery is going to be our primary rose and citurs fruit dealer. Windmill farms will give us the basic everyday 6 packs that people will buy for their outside landscaping. We will only use windmill farms for the summer months to gain a little bit of extra business to sell outdoor plants. Now that we have gone over how and where we will get our product the next aspect is how the actual store is going to be set up. The approximate size of the store will be 1500 square feet inside and 1000 square foot outside area for summer plants. The store will be organized by type of plant on both the inside and the outside. Our staff on any given day will include me and one other manager and at least three other employees to help out the majority of the customers. The store hours will be from 9-7 Mon-Saturday and 10-6 on Sundays. The managers will be the ones that run the registers the majority of the time well the associates help customers find and load what they need into the car. One other responsibility that everyone will have is making sure all of the plants get watered every single day. Watering is the number one reason the nursery’s have shrink so it will be everyone’s job to do this At the end of every day the managers that close will be responsible for counting down all of the registers and making sure the store is clean and ready for business the following day. These roles can be modified if need be due to call offs or any other issues that may come up. We will also have at least two traveling care takers for homeowners and business owners that will go from place to place and take care of people’s plants. These will also be the individuals that make long distance runs to the nursery’s to pick up  product. Monday will be a very crucial day for the business. The managers will do inventory and decided what we are going to need for the next couple weeks. They will then call it in to the different vendors and set up a Thursday or Friday pick up time. Monday and Tuesday will also be the days that our traveling plant specialists will go to appointments to take care of people’s plants. This will all be going on behind scenes well the store is operating its daily business. Wednesday the plant specialists will leave in two boxes trucks and travel to Florida where they will load up the two trucks and return home before Saturday so that the store can be replenished with merchandise. Upon returning on Saturday the associates will unload the truck and the managers will do a second check to make sure everything has arrived not only in good shape but also the proper quantities. This seems like a lot of work but it is very important to only have the freshest product for our customers and will also make it so that we can keep prices lower. This will be a typical week at Marshalls. I have found that over my years of managing similar businesses nothing is every set in stone and adjustments will have to be made as we go. This is just a general blueprint for what a week will look like. We have been looking at the idea of getting several of our products from the Caribbean islands. There are many pros and cons of doing this. The first thing that we noticed was that we were able to get products a lot cheaper per plant but will have to pay almost three times the shipping to get them back to the U.S. The reason that they are so much cheaper is because the labor to grow them is less than half what we pay people in the United States. Countries like Haiti pay people only dollars a day. Many of the growers also do not fallow the laws of the U.S and use pesticides and fertilizers that have been banned. This is especially relevant when trying to ship fruit trees that are going to potentially be consumed by people. Dealing with the government of some of these other countries is also very difficult because they want to control what is being shipped and often times will confiscate things at the border that they feel is odd. When this happens there is no guarantee that we will ever get what we ordered and can  often times result in huge losses. A typical order can range anywhere from 2000 dollars up to 20,000. One lost order can ruin a half of month’s sales. Like any business networking is key in success so by gaining overseas contacts it can greatly increase sales and even potential locations to expand to. We have even looked at opening our own greenhouse and fields in some foreign countries to produce our own plants. This is just a basic overview of what the operations for Marshalls will look like. Many things will come up that may change how the company will be run. Many factors such as weather and war may dictate what will happen. If we are able to stick to this plan as close as possible we should be profitable within the first two years of being open. A cash flow analysis is an important part of any business that is planning on succeeding and growing in the future. Marshalls is no different than any other business in that it needs to have an accurate cash flow statement. This will give us a better idea of how the business is doing and where the cash is flowing in the business. It is important as a small business to prepare these documents as frequently as possible. This can be done anywhere from monthly to annually. In this paper we will look at what goes into a cash flow analysis and what some of the benefits are for keeping an accurate cash flow analysis. The first part of the cash flow statement that you will need to know is the net income. The net income is the total amount of money that will be brought in. This will be a base number with nothing taken out for liabilities or money that was spent. Marshalls had a net income of 545,000 in the first year of doing business. Operating activities is the first thing that needs to be analyzed for a cash flow analysis. This will include anything that will produce direct revenue or any of the costs that may come up when producing a good or a service. When looking at what might cause cash inflow, you would consider thing like customer sales from primary products. For Marshalls this would be anything that we would sell to the public. The main out flows that we will have to  consider for operating activities would be paying suppliers and employee payrolls. The money that will go out to our suppliers will be around 100,000 and our payroll for the year will be around 300,000 all together for our employees. Investing activities is the next area of that we will look at when making a cash flow analysis. This will be higher for the first year because of the property that we will be buying. This is a noncurrent asset that will generate a lot of money for us over time. The property is we bought is 200,000 and will only have to be deducted for the first year of the cash flow statement. Equipment for the company is also in this category because over time we will make money from this. The total cost of this is going to be 20,000. Financing activates is the final area on the cash flow analysis that Marshalls will have to take into consideration. This area will be anything from having to barrow money for new equipment to using cash to pay off a property loan. Marshalls will have to be making payments on equipment and also on the cost of the mortgage for the building that they will be located in. There are many benefits to preforming a cash flow analysis and is necessary for any size business. The first thing that we need to consider is that this is the final report that is prepared. This means that it takes into account everything that was in the other financial statements. This statement will show accountability and validity of all the other kinds of statements. This is a great way to analyze how healthy a business is when you are considering doing business with them or investing with them. This report will also make the company a lot more credible when trying to entice investors and other financing. Many problems will arise if this report is not done properly and in a timely manner. Cash flow statements are the overall performance of your business and by not knowing where you’re sitting it can have terrible future implications. Including, overspending and not being credible to potential  investors. Information technology can be a make or break of a business. It can not only save the company a lot of money but also at the same time protect valuable information. This information can include anything from business account numbers, customer information, vendor lists and product margins. All of this is going to be information that you would not want to lose or get stolen by potential competitors. The first thing that we are going to look at is going to be types of hardware that we will be using at Marshalls to make it as safe and user friendly as possible. The hardware that we are going to be using for this business is going to be pretty simple because of the nature of the business. We will have two computers that will be for ordering information and managing the website online. These computers will also field all email questions by customers from the website. We will also have a laptop for the delivery guys to use to make sure that all of the products they are picking up are correct and for lite personal use on two and three day trips. In the office there is a multipurpose printer that has the ability to copy, fax and print. To stay up with the times we have decided to also integrate two I-pads into our company to take credit card sales on the spot and make answering questions easier for the customer. Software is going to be an area where we will not need to spend a lot of money to start out. I figure that we will get QuickBooks to do our accounting and the Microsoft office suite to do the majority of the other features. In office suite there is a program that is called accesses and will build a database of customers and we will use that heavily for direct mail and contacting potential customers over time. The one area that we will not skimp in is anti-virus protection the reason that I say this is because it is going to be important to protect all of our information. Marshalls is going to use email very heavily for their business not only to stay in touch with customers but also to order product and keep in contact with the delivery people that are on the road 3 days a week. Marshalls  Email is [emailprotected], the reason that we decided on this email is because people will easily be able to distinguish us when looking through their emails. We also used Google as our home for our email because it is not only free but can hold the most amount of emails. We will have a basic network that will link all of our electronic devices to the main desktop PC in the manager’s office. All important documents will then be stored in external hard drives as well as on the device that it was transferred from. This will ensure that we will never have an issue where we lose paper work or information that we will need at a later time. For the laptop and I-pads we will have wireless internet at the store and the ability to have ATT 3g for the laptop on the road. Our website is going to be very simple in design with a basic landing page that will search engine optimized to increase relevance and raise our spot on search engine pages. The page will have a spot where customers can get basic information and see approximate in store quantities. The main concern for www.Marshallstropical.com is going to be that due to the ability to order, schedule appointments and get plant information on our site it will have high volume of people at the site at any time making it slow if not shutting it down. This concern for heavy usage on the website has made Marshalls staff decided to implement cloud technology. Cloud technology is a somewhat new technology that eliminates the need for multiple servers. This alone is going to save you a ton of money in basic server costs. Normally a server is going to have to have a host and you will be charged no matter how much you actually use it. You also will have to buy more servers as the site gains popularity or it will slow down dramatically. Customers hate not being able to streamline across a site and will often not even consider a site that is not in fast working order. What cloud technology will do for us is not only eliminate the need for servers but also increase our scalability. Meaning the site will be able to handle more people when needed and scale back down when traffic is slower. This makes it very convenient because you never have to worry about your site being slow due to high traffic and potentially  losing sales. Cloud technology is also a performance based asset. The reason I say this is because you are only really paying for it when people are using it. This being said when people are looking at your website that is creating leads and the potential for customers so you are really only paying when it’s being used. This can all be done from one computer and is a very simple. With the little bit of time I will have on my hands running the business simple is better. This is just the start to what we can do with information technology in our business. Since we are so small we will be able to run lite in this area for a while. When we start to get bigger and open up new locations the need for information technology expansion will be needed. The most important thing overall is our security and the ability to protect our information yet stay streamlined for the customer’s needs. Management in any business is going to be an important factor. A business that is not ran properly will often times not be around for more than a couple years. Poor management will affect customer satisfaction as well as employee satisfaction. It is often a trickledown effect with an end result of customers not wanting to shop at that place of business and the business not being able to hire potential qualified candidates. At Marshall’s nursery we will have four managers that will run the business. One of the managers is going to be the owner and will have the final say in any issues that may arise. This is going to be somewhat of an autocratic management style but since the owner has the final say. I feel that I should have the final say on this because it I am solely taking the entire financial risk in the business. Not only am I taking the entire risk but I also have more experience running the business than any of the other managers that are fresh out of college. Marshalls will also have an offsite accountant that will be responsible for the weekly reports and making sure all the books are kept up to date and correct. We also have the ability to bring in outside consultants that will help train our employees about the different types of plants and plant care. All of the employees at Marshalls will have to be team players, when you are running a large business with a staff of 12. Employees will have to learn how to work together in order to get everything accomplished that needs to be done. I stated that it was going to be an autocratic work place for the first couple years but I hope to move more to a democratic type of management style when we get established. I want all of the managers to have a say in how the business is run and implement things that they feel is going to help the business out over time. Only fallowing ones persons ideas and direction will eventually hinder its ability to grow into a unique business. Communication at Marshalls is going to be very important because of the nature of the business. We will be running three different shifts that will only overlap by a couple of hours. Since the overlap is so little, we will have to utilize emails, texts and interpersonal communication in order to get our daily business done. Information that is business sensitive will only be available to the managers and accountant. Many things over the course of any given day will have to communicate. Some of these things will be watering logs, work lists and schedule changes. All of this information will be emailed to each employee. Organizational culture is how the employees interact with each other with in an organization. An organization can be defined as anything that a group may partake in. Organizational culture can be how people interact with each other and their beliefs, habits, values, visions, norms and many others. Since it is very hard to match people up that have the exact same traits we will have to ensure that here at Marshalls we will have to do the best we can in the interview process to get a good mesh of people. No business can handle people bickering and fighting every single day. In the event that a labor strike were to happen in the middle of my peak season it would very difficult to keep my plants supplies up. The first thing that I would need to do is find out what I have exactly on hand and figure out how long mu current inventory would last. After figuring out my current inventory I would then have to start shopping around for the next  best suppliers that have similar prices and adjust my prices accordingly. I would probably have to bring on a couple seasonal drivers so that I could utilize several different vendors for the season and keep the orders coming. Competition in this business is already fierce and I have found a niche market. If more of the same types of businesses pop up around me. The first thing I will have to do is get a hold of my suppliers and let them know that if they want me to keep ordering than they will not supply to any of the surrounding areas. This may seem harsh but they will understand since I have done business with them longer and most likely am ordering bigger quantities. After doing that I would have to scope out the competition and see if they are similarly priced to me. Slight adjustment in prices may be needed to ensure that we are the best priced place in town. This will also have to be monitored closely over time to make sure that we stay the cheapest. Laying off employees is never an easy thing to do especially when you have built a tight group like we have at Marshalls. The lingering affect can be the worst part of a large scale layoff. The most important thing that you have to do is ensure the people that do still work for you that their jobs are safe and they don’t have to worry every day about losing their jobs. After you have reassured them of that I would then offer them the ability to have a couple extra days off when needed to cut payroll and let them know that you will be able to work around their schedules better. This may seem crazy considering you just laid employees off but it’s an easy way to shed parole and give a small morale booster to the current employees. Managing a small business is not an easy thing to do. Often times it can be stressful, sad, fun and overwhelming. The monetary payouts and the feeling of success within the business can often times make the job very desirable. In the contemporary world, the use of mass media has been on the increase and thus this has not exempted its use in the political arena. As such, a liberal democratic society is the one in which elections are fair and free while encouraging competition in the political process. In this sense, the government is used as a tool of making developments where they are needed. On the other hand, democracy brings about vesting of authority on the citizens. In addition, a liberal democratic society should actually provide sufficient information along with transparency in the matters of political decisions. As well, it should provide competition in terms of ideas and arguments which encourage participation from the members of the society and thus meet the demands of a democratic society. According to research, mass media has a great role to play in the context of a liberal democratic society. As such, it has been pointed that there are three major roles that media plays in the given society  [4]  . The most important one has been pointed out as the media acting in the capacity of a regulator against the state. In the same line of thought, the media is given to the role and responsibility of ensuring that accurate as well as sufficient information is provided to the society from the larger point of view. Accordingly, the mass media has another major role to play which cannot be underrated. As a matter of fact, it should work hard to ensure that it represents people in the sense of sufficiently reflecting the range of public opinions together with the aspect of political competition  [5]  . It is important at this point to note that media has a major communication role to play in the context of a liberal democratic society. So to speak, communication entails the facilitation of the public dialogues, representation of the public, making the public to live being informed, and acting as a regulator or rather a watchdog of the structures of power which affect the wellbeing of the public. As well, media is used as a tool of social unity and thus it is important to bring into view the major types of media systems in use to accomplish roles assigned within a democratic society. In line with this point, media covers the instruments of communication employed in order to accomplish the roles of communication in a democratic society. As such, these instruments of communication involve books, internet, films, newspapers and TVs among others as such. Basically, the media is expected play the role of a watchdog for the public. This is to suggest that it should take the responsibility to protect the very citizens or rather the society it is mandated to serve. So to articulate, the public is always out to see that the media is regulating the power structures of the society by exploring their functioning and then notify the public when there has arisen some issues in the structures  [6]  . This is also accompanied by the media pointing out to the interests of the people and where they want to act. Another point to note is that a liberal democratic society as it has been highlighted requires a good flow of information. This is to suggest that the public requires to get information and to stay informed. In such as society, citizens are inclined towards making collective decisions for the societal benefit altogether. In the light of this point, democratic societies grow when there is flow of the shared information among the society members and thus it is imperative for the media to inform the society regarding the contemporary issues that need attention and the public stance in regard to them. As far as social unity is concerned, the media acts as a tool that works to bring together the members of the society by making use of a common culture which is only achieved when the media gives the society an experience of culture that is shared. According to research findings together with arguments from various scholars, media as a key player in the flow of information in the society has failed in most of its roles. This is what has brought about the misconception of the proper role of the mass media in a liberal democratic society. However, pointing out to what should be done so that the media can play its proper role, will help to alleviate the burden of the media abuse in a democratic context. As such, the mass media should not accept the manipulation by the political leaders who use it for selfish interest  [7]  . In the light of this point, the media should seek to ensure a universal access in that members should be given room to the right of entry to the mass media to contribute as well as gain from the public. The role of the mass media in the democratic society will be realized again when the mass media works independent from the structures of power present in the society. In all the undertakings of the media, influential leaders should be presented separately from the titles so that there may be no bias. Owing to the manipulation of the mass media by influential leaders, mostly the media may ignore the interests along with the concerns of the public and as such, this should not be done but rather the media should respond to the public interests and concerns altogether. It is the responsibility of the mass media again to state the different constituencies of the democracy. So to speak, it works towards the creation of common experiences to the society while offering shared public symbols. Needless to say, it is through media that the public gets to interact with the leaders and as such solicit information from them. Accordingly, mass media plays the role of constantly reminding the society the essence of their national identity  [9]  . Following this point, the instruments of media have experienced developments which are closely linked to the technological development. This is to suggest that it is not only though books, newspapers and TVs among others that the mass media operates, but rather internet has come into the scene. Thus, it is possible for the political leaders to use the internet to influence the citizens and as well interact with them  [10]  . Of importance to note in this case is the abuse of mass media by the leaders in order to serve their self driven interest. Therefore, regulation of the mass media should be carried out so that no cases of abuse can be reported. Arguably, contemporary democracy has been pointed out as not to be working. This is given to the reason that the media has engaged in politics with the citizens engaging in the internet citizenship and thus the point of contact and development has been lost  [11]  . GCSE English Coursework – Wide Reading Assignment - Lamb to the Slaughter by Roald Dahl, and The Speckled Band In this wide reading assignment I have been looking at two stories, 'Lamb to the Slaughter' by Roald Dahl, and 'The Speckled Band' by Sir Arthur Conan-Doyle. Both these stories are classed as murder mysteries, and I am intending to investigate and compare the motives of the killers in both stories. 'The Speckled Band' is written in first person from the viewpoint of Dr. Watson. The story starts with Watson looking over notes of the cases that he and Holmes have taken in the last eight years; one in particular comes to his mind, and from their Watson tells the story of 'The Speckled Band'. The killer in 'The Speckled Band' is Dr Grimesby Roylott. Roylott is a tall man who was well built. 'Lamb to the Slaughter' is written in a third person perspective, and the story starts with a description of a room, and then breaks into the characters, and follows them though the rest of the story. The killer in 'Lamb to the Slaughter is Mary Maloney, a gentle, petite housewife. The two stories, as previously said, are both classed as murder mysteries, however when comparing these two stories the styles of writing and the way in which the stories are presented is completely different. An example of this would be the chronological order of each of the stories. What I mean by this is the traditional order of murder mysteries would be body, a motive, a weapon, a death, a suspect, an alibi and detectives. Lamb to the Slaughter and The Speckled Band are no exception to these "guidelines". The Speckled Band follows this order and is a very traditional murder mystery; Lamb to the Slaughter on the other hand does not follow the conventional style of murder mysteries and follows its own order. Berlin Crisis of 1961 from Perspective of Realism Theory Essay

Berlin Crisis of 1961 was the most dangerous moment of the Cold War. This conflict was mainly about the occupational status of Berlin. Berlin Crisis initially emerged in 1958 by the provocation of the Soviet Union. Soviet Premier Nikita Khrushchev threatened to conclude a separate peace treaty with East Germany unless the western powers recognized the Germany Democratic Republic (GDR) (I. W. Trauschweizer, 2006). However, the escalation of tensions began after the Vienna Summit in June 1961, where the USSR again raised the issue of ultimatum, which gave the United States six months for the withdrawal of Western armed forces from West Berlin. Berlin Crisis was not the only crisis during Cold War. Through the whole history of humanity there has always been a question why do wars and conflicts occur? In order to give an answer to this question we should explain some factors which made the war to occur. Crisis and especially Berlin Crisis can be understood from several perspectives, but in this paper it will be explained from realism theory perspective. As a famous representative of realism theory, Waltz asked himself the question why do wars occur? Waltz’s question is as old as war itself, possibly because â€Å"to explain how peace can be more readily achieved requires an understanding of the causes of war† (Waltz, 1959: 2). By the time Waltz posed this question, many answers to it already existed. These answers fell into three categories (or as IR theorists came to define them, were found at the three â€Å"levels of analysis† or in the â€Å"three images†). These three categories/levels/images are: the individual, the state, and the state system† (C.  Weber, 2009, p. 17). These main causes of conflict will be represented in detail in the main body of the paper by the example of Berlin Crisis. Although Waltz’s three categories of the causes of war explained many processes in the Berlin Crisis, there are also important points in the theory of realism, which typically explain Berlin Crisis, one of those points is the issue of bipolarity or multipolarity of the world. Morgenthau, an American academic and journalistic writer, in contrast to Waltz saw the stable world in multipolar rather than in a bipolar system. From his perspective bipolarity was dangerous for the world’s stability, because as we will see next, Berlin Crisis was the result of bipolar system, where two great powers tried to dominate the others, by increasing their power and authority. As Waltz said, each great power sought to survive. Thus, realism theory explained Berlin Crisis from many points of view. In order to better understand Berlin Crisis of 1961 from realism theory perspective, I will present the main points of realism theory. After, I will give a short historical background of Berlin Crisis and to summarize all these, I will illustrate how well realism theory explained the Berlin Crisis. The Realism Theory The most dominant theory throughout the Cold War was realism. Realism had a negative viewpoint concerning to abolishment of conflict and war. It described international relations as a struggle for power. The domination of realism during the Cold War was due to the fact that it gave simple but powerful explanation for war, alliances, imperialism, obstacles to cooperation, and other international phenomena, and of course, the competition was mainly related with the features of the American-Soviet rivalry (S. M. Walt, 1998). However the realist thought developed during the Cold War. †Classical† realists such as Hans Morgenthau considered that states, as human beings, had a wish to dominate others, which brings about a war. Giving advantage to multipolarity, Morgenthau considered that the bipolar rivalry between United States and the Soviet Union was very dangerous (S. M. Walt, 1998). â€Å"In contrast to â€Å"classical† realism, the â€Å"neorealist† theory, advanced by Kenneth Waltz, ignored human nature and focused on the effects of the international system (S. M. Walt, 1998, p. 31)†. He claimed that international system included great powers, which were seeking to stay alive. In contrast to Morgenthau, Waltz considered bipolar system more stable than multipolarity. When there are more than two poles, things get trickier. Balances are harder to strike and therefore risks increase, which brought about the wars (C. Weber, 2009). One of the most important features of realism is a theory of offence-defense. It was developed by Robert Jervis, George Quester and Stephen Van Evera. â€Å"When defense had the advantage and states could distinguish between offensive and defensive weapons, then states could acquire the means to defend themselves, without threatening others† (S. M. Walt, 1998, p. 31). â€Å"Defensive† realists thought that all states were seeking to survive and in this case, by creating alliances and adopting self-protective military position, great owers could solve their security problems. And as an example, Waltz and other neo-realists thought that the United States was protected and secured during the Cold War. Realists and neo-realists agreed that the prime aim of states was to survive and the increase of their power is the only way to guarantee their survival, because states with less power might fear of those with more power and therefore the possibility to attack them was the minimum. Besides, realists and neo-realists agreed that there was no possibility to get out from international anarchy. However there was one thing they disagree about: the issue of human nature. For example, Morgenthau argued that the nature of a man (and he meant the gender exclusive term â€Å"man†; see Tickner, 1992: Chapter 2) was defective and international politics would remain anarchical and conflictual because of the nature of man. Neorealists, of whom Kenneth Waltz was the first, disagreed with this consideration. â€Å"They argue that instead of looking to â€Å"natural† causes of conflict, we need to look to â€Å"social† ones (C. Weber, 2009, p. 16). ’ Waltz thought that the organization of social relations and not the nature of man determined there was a war or not, because states go to war as they are in a bad social organization. So, for realists, international anarchy was just the environment in which sovereign nation-states acted. For neo-realists, international anarchy described the social relations among sovereign nation-states, which explained why wars arise. By the end of the Cold War, realism had moved away from Morgenthau’s gloomy human nature and was taken on a little more positive stage (S.  M. Walt, 1998). Historical Background of Berlin Crisis After World War II Germany was divided– first into four sectors, with American, British, French and Soviet, and then into two, as the three Western sectors coalesced to form the new Federal Republic of Germany, leaving the Soviet sector to turn into the German Democratic Republic (John P. S. Gearson, K. Schake, 2002). And during this period Germany had two major cresses, but the 1961 Berlin crisis was generally perceived to be more dramatic and dangerous than its 1958 predecessor. The Kennedy Administration was more inclined than its predecessor to consider East–West disagreement over the Berlin crisis. President Kennedy gave a speech to the nation about preparing for war and began a $3. 4 billion military build-up in the summer of 1961. Both the US and the Soviet forces had a dramatic confrontation at a military checkpoint in Berlin. â€Å"Initially, The Berlin Crisis began in 1958, when Soviet Premier Nikita Khrushchev threatened to conclude a separate peace treaty with East Germany unless the western powers recognized the Germany Democratic Republic (GDR) † (I.  W. Trauschweizer, 2006, 206). However, the main crisis heated through 1961. It escalated at the Vienna summit between Khrushchev and Kennedy in June 1961, when Khrushchev again raised issue of his ultimatum. Kennedy left Vienna shaken and expected the worst from the Soviet leader. He decided to increase the personal strength of US armed forces in Europe. However, the first step of aggression did the Soviet Union. On 13 August, East German police units closed the border between the Soviet sector and the three western sectors of Berlin. The construction of the Berlin Wall in August 1961 was one of the defining moments of the Cold War, and heightened the sense of tension. It was the moment when the crisis was stabilized. Even as it became increasingly apparent that Berlin was unlikely to provide a hot war, it provided the Cold War with its most conspicuous symbol, a regular stop for any visit to the city, a chance to stand and look over into a grey east and compare it with the wealth behind (John P. S. Gearson, K. Schake, 2002). The division of Berlin and building a wall was a shock for the Kennedy administration. Most of the United States government officials were expecting that the crisis would revolve, but there were some in the administration who thought that the East German government would take measures to stop the flow of refugees from East Germany, and they believed that the border closing might reduce tensions rather than lead to escalation. In order to enforce his influence in Western part of Berlin Kennedy decided to appoint Clay, who was a chairman of the Continental Can Company in New York, as his Special Representative in Berlin with the rank of Ambassador. Kennedy considered sending Clay to Berlin for the duration of the crisis in order to boost morale in the city, but also to create conditions that would persuade Soviet leaders to join in serious negotiations (I. W. Trauschweizer, 2006). The stand-off of Soviet and American tanks in the heart of Berlin in October 1961, constituted the most dangerous moment of the Cold War in Europe and it was one of the last major politico-military incidents of Cold War. As per standing orders, both groups of tanks were loaded with live munitions. The lert levels of the US Garrison in West Berlin, then NATO and finally the US Strategic Air Command were raised and both groups of tanks had orders to fire if fired upon. Clay was convinced that using US tanks as bulldozer to knock down parts of the Wall would have ended the Crisis to the greater advantage of the US and its allies without drawing out a Soviet military response. His views, and corresponding evidence that the Soviets may have backed down following this action, supported a more critical assessment of Kennedy’s decisions during the crisis and his willingness to accept the Wall- as the best solution. After, Kennedy and Khrushchev agreed to reduce tensions by withdrawing the tanks. One by one the tanks withdrew and Clay returned to the United States in May 1962. Anyway, there was no doubt that the Berlin Crisis and in general, the Cold War was really over when the Wall came down in November 1989. Berlin Crisis from Realism Theory Perspective As the most dominate theory during the Cold War was the realism we easily can view Berlin crisis from the perspective of this theory, because Berlin crisis was one of the major conflicts during the Cold War. Realism explained many processes of Berlin Crisis, but there were some miscalculations concerning to it. All about these will be represented in this part of the paper. The main competition in the world realism theory saw between the United States and the Soviet Union. Realists claimed that bipolar system of world was very dangerous and gave an advantage to multipolarity. Thus, the bipolar system was very typical during Berlin Crisis, but from the neorealism perspective the bipolar world was more stable. Here neorealists had a miscalculation, because during Berlin Crisis bipolarity dominated in the world and history shows that tensions were more escalated than ever. Thus, from this point of view realists’ thoughts more corresponded to reality, than that of the neorealists. From the perspective of realism theory states must have power in order to survive. United States and Soviet Union tried to do so by strengthening the power in Europe. According to Morgenthau human beings sought to get power and to dominate others. The Berlin Crisis was good example for this idea. Both the United States and the Soviet Union were doing everything to get more power in Europe and to dominate each other. After Vienna’s summit, tensions came obvious and the first reaction of both great powers was how not to lose power over Berlin. The result was the Berlin conflict. The building of Berlin wall can be described by the wish of great powers to survive in this situation and the increase of power was the main guarantee for survival. From the perspective of realism theory fear also made these two great powers to dominate in Berlin. Both the United States and the Soviet Union took actions from fear of losing a power. After Vienna summit Kennedy was shocked and expected everything from Soviet Union. And the fear of not losing a power made Kennedy to turn to drastic actions by increasing the power over Berlin. Berlin Crisis was a result of using force. Here is the good example of Acheson’s report â€Å"The Soviets would provoke a crisis in Berlin to take advantage of US conventional force inadequacies and humiliate the new Administration† (John P. S. Gearson, K. Schake, 2002, p. 31). In the Realism theory there was another important element of aggression during the Cold War. This kind of behavior we can see from the United State’s side. National Security Adviser Mc. George Bundy endorsed the Acheson report, urging the president that â€Å"Berlin is no place for compromise and our general friendliness and eagerness for improvement on many other points really requires strength here in order to be rightly understood† (John P. S. Gearson, K. Schake, 2002, p. 31). The aggressive tone of the Acheson approach and its support in the Administration contrasted with the political compromises President Kennedy wanted to be in Berlin, but Khrushchev’s belligerent behavior at the Vienna summit convinced the president of the Acheson argument. However, whatever the positions of both sides were â€Å"The Berlin crises of 1958 and 1961 suggested that the range of political choice was defined less by military capabilities than by the nature of the political conflict that gave rise to the use of force and by the willingness of adversaries to accept risk in order to achieve their political goals† (John P. S. Gearson, K. Schake, 2002, p. 38). However why did this crisis occur? Waltz asked himself a question like this one: why do wars occur in general? The answers to this question fell into three categories: the individual, the state, and the state system. Waltz argued that the major causes of war could be found at each of these categories and none of them alone could explain why wars do or do not occur. He came to this conclusion by beginning to look at the first category- a man. From the first category Waltz explained the war like this â€Å"the locus of the important causes of war is found in the nature and behavior of man. War results from selfishness, from misdirected aggressive impulses, from stupidity†¦ If these are the primary causes of war, then the elimination of war must come through uplifting and enlightening men or securing their psychic-social readjustment† (Waltz, 1959: 16). This idea is common with the behavior of Kennedy and Khrushchev during Berlin Crisis. In the basis of this conflict a nature and behavior of both Kennedy and Khrushchev can be found. They both had an aggressive behavior. Explanation of war of â€Å"men behaving badly† is very typical for Khrushchev, when in June 1961 Khrushchev again raised the issue of his ultimatum, which claimed an immediate withdrawal of US armed forces from Berlin. â€Å"Man behaves badly because he is bad by nature. He acts unreasonably or he prioritizes selfish goals over communitarian goals, and this is why conflicts and wars occur† (C. Weber, 2009, p. 17). As we already know for Waltz man alone cannot causes wars. He thought that man’s nature was too complex to be the direct and main cause for war. For the Berlin Crisis we can conclude the same. Even the great players of this crisis were the United States and the Soviet Union leading with Kennedy and Khrushchev, only their nature and behavior were not enough to incite conflict. Thus, we can look to social and political institutions to complete our understanding of why wars occur and especially why Berlin crisis occurred. Waltz asked whether the occurrence of wars could be explained by the internal organization of states and societies. Second category theorists argued that there are good and bad states, because of their formal governmental arrangements: for example, democratic vs. autocratic or their less formal social arrangements, who owned the means of production. Second image theories claimed that bad actors (this time states) make war, and good actors preserve the peace. However, there is no common answer which is a bad one and which is good, because some suggested good states would be democratic, others say they should be monarchical, others still say socialist. Waltz suggested, even if second image theorists could agree on what a good state was, there was still no guarantee that a world of â€Å"good states† would be a peaceful world. From this viewpoint realism theory could not explain which kind of state was good or bad, and we cannot say the democratic America or the socialist Soviet Union were the causes of the risis. Waltz concluded that this level of analyses was incomplete. For the third category he gave linkages between anarchy, state actions and conflict. â€Å"In anarchy there is no automatic harmony†¦ A state will use force to attain its goals if, after assessing the prospects for success, it values those goals more than it values the pleasures of peace. Because each state is the final judge of its own cause, any state may at any time use force to implement its policies. Because any state may at any time use force, all states must constantly be ready either to counter force with force or to pay the cost of weakness (Waltz, 1959: 160)† (C. Weber, 2009, p. 18). Waltz called bad social organization international anarchy. International anarchy is the permissive cause of war† (C, Weber, 2009, p. 16). From this viewpoint realism described the social organization of states and the cause why crisis started. Taking into account the ideas of Waltz, that in the world there was international anarchy, we can say that Berlin crisis was the result of it. These can bring about the idea that both United States and Soviet Union were in bad social organization. Waltz concluded that wars occur, because there is nothing to prevent it. So, for Waltz, international anarchy explained both why wars may occur and why there are limits on cooperation among states in the international system. Waltz argued that only international anarchy has the power to explain why wars may occur, if individuals and states have nothing to fear from one another, then they have no cause to fight with one another. This idea can be linked with the fear of Kennedy, when he left Vienna. He was expecting anything from the Soviet Union and the fear made him to strength the military personal of US armed forces in Berlin. He wanted to survive by maximizing power. Waltz believed that we need to look at â€Å"social† causes of conflict rather than on â€Å"natural†. He explained that good men behave badly in bad social organizations, and bad men can be stopped from behaving badly if they are in good social organizations. States go to war, then, because they are in a bad social organization. From the realism perspective the United States also had bad social organization, because the Kennedy Administration did not understand the 1961 crisis in these political terms. They viewed Soviet pressure on Berlin as a military challenge to declining US superiority, and concentrated their efforts on military responses. The Administration began a series of defense improvements and public commentary that exacerbated the instability of the East German regime and raised US–Soviet tensions. They abandoned this confrontational approach in August of 1961 when the Berlin Wall was constructed, opting instead to reduce US–Soviet tensions by supporting the long-term division of Germany (John P. S. Gearson, K. Schake, 2002). â€Å"While it is questionable whether the Kennedy Administration, new to office and without Eisenhower’s war fighting credibility, could have succeeded with the Eisenhower approach to Berlin, the stridency with which the Kennedy Administration approached the crisis exacerbated the problem, both with the Soviet Union and among the Western allies. The US failure to follow through on its hard-line approach when the Berlin Wall was built raised serious questions about the practicality of the Kennedy Administration’s new military strategy and the reliability of the US for its European allies† (John P. S. Gearson, K. Schake, 2002, p. 22). As we can see the main purpose of this conflict was to get power. Morgenthau said that â€Å"The struggle for power is universal in time and space† (Morgenthau 1948: 17) (J. Donnelly, 2004, p. 10). Waltz also shared an opinion concerning to power â€Å"The daily presence of force and recurrent reliance on it mark the affairs of nations† (Waltz 1979: 186) (J.  Donnelly, 2004, p. 10). Structural realists give predominant emphasis to international anarchy. For example, John Herz argued that international anarchy assures the centrality of the struggle for power â€Å"even in the absence of aggression or similar factors† (Herz 1976: 10; compare Waltz 1979: 62–63) (J. Donnelly, 2004, p. 10). The Berlin Crisis was vivied example of sharing the the power between two great powers and the thought of Waltz that states need a power in order to survive is very typical for Berlin Crisis. Conclusion To summarize all above mentioned I would like to say that the realism theory, which was the dominant one during the Cold War, explained many processes of Berlin Crisis. In general it gave important answers about Berlin Crisis. Realism emphasized the constraints on politics imposed by human nature and the absence of international government. Together, they make international relations largely a realm of power and interest (J. Donnelly, 2004, p. 9). All realists emphasize the egoistic passions and self-interest in politics. The realists put emphasis on power and claimed that states need the power in order to survive. In case of Berlin Crisis, United States and Soviet Union maximized their power in order to get a dominant role in Europe. At the same time fear also made them to turn to radical actions. Especially United States increased the US armed forces in Berlin. So the combination of the wish to have more power and a fear to lose a power can be viewed as the causes of conflict. From the realism theory perspective there were also elements of aggression through Cold War, especially during Berlin Crisis. The aggression can be found in both United State’s and Soviet Union’s actions. However, the main reasons why this conflict occurred were described by Waltz. He represented the conflict by three categories. For him the three categories combined can made war to occur, but in general the first and the second categories can explain the Berlin Crisis. The third one, even cannot distinguish which is good state and which one is bad: in the case of Berlin Crisis we cannot say United States was good and Soviet union was bad or vice versa. Anyway, Waltz argued that good men behave badly in bad social organizations, and bad men can be stopped from behaving badly if they are in good social organizations. States go to war, then, because they are in a bad social organization (John P. S. Gearson, K. Schake, 2002). The only thing Waltz had miscalculation about was the multipolar system, because he saw the stabile world within the framework of bipolar system, but in reality, during Berlin Crisis bipolar world was very dangerous. We can conclude that realism theory managed to explain the Berlin Crisis from many points of view. There were some issues during Berlin Crisis, which realism theory could not cover, but the main aspects of it can be easily described from the realism theory perspective. To summarize the thoughts of major thinkers of realism and neorealism theory, which characteristically explained the Berlin Crisis, we can say that for Waltz the state’s interest provides the spring of action and the necessities of policy arise from the unregulated competition of states and calculation based on these necessities can discover the policies that will best serve a state’s interests. For Morgenthau, politics is governed by objective laws that have their roots in human nature and the main mark that helps political realism to find its way through the landscape of international politics is the concept of interest defined in terms of power. Thus, power and interest are variable in content (J. Donnelly, 2004).
